On September 26, 2017, a truck spilled thousands of roofing nails on Interstate 10 in Metairie, Louisiana (a suburb of New Orleans). Hundreds of vehicles rolled over the nails and sustained punctured tires, resulting in replacement of tires that may total as much as $1,000 per vehicle. The Louisiana State Police cited the driver for failing to properly secure his load. However, the State Police did not immediately identify the driver or the trucking company, and even encouraged damaged drivers to submit claims to their own insurance company. As a result, Louisiana auto property insurers may receive many new claims for replacement tires, towing charges, and rental vehicles. Jim Busenlener, managing partner of MWL’s New Orleans office, has identified the driver, trucking company, and their insurer, and is already preparing reimbursement claims. If you have received claims related to this loss and are interested in a subrogation recovery, please contact Jim Busenlener at jbusenlener@mwl-law.com.
